Terms of Service
These terms govern your access to and use of Fanogram, operated by Social Commerce Ltd (registered in England & Wales) and Social Commerce EU Ltd (registered in Cyprus). By creating an account or using the service you agree to these terms.

1. Who can use Fanogram
- You must be at least 18 years old.
- You must complete KYC verification before receiving payouts (per decisions log §15 — two-stage flow: identity + selfie for payouts; video KYC + proof-of-address for adult-tier features).
- You agree to provide accurate information and keep it up to date.
2. Roles
Fanogram supports four account roles. Capabilities vary per role and are described in our decisions log §22:
- Creator — primary subject of a fan-facing bot. Owns conversations, vault content, settings, payouts.
- Chatter — invited team member who replies on the creator's behalf with explicit, time-bounded permissions.
- Agency — multi-creator account holder. May act on behalf of any creator on its roster who has granted access.
- Admin — Fanogram personnel; not a customer role. Admins may access, view, and act within accounts for the operational and security purposes described below.
Admin access to accounts. To operate the service, keep it secure, and comply with law, authorised Fanogram personnel may access, view, and—where necessary—act within a Creator, Chatter, or Agency account (including viewing conversations and content, and sending or managing messages on the account's behalf). This access is used only for legitimate operational purposes, including: customer support and troubleshooting; security, fraud, and abuse prevention; content moderation and Terms enforcement; regulatory and legal compliance; and maintaining the integrity and reliability of the platform. Such access is restricted to authorised personnel, gated by role-based permissions, and recorded in an audit log. It does not change who owns the account or its content, and is separate from the prohibition in §9 on users impersonating others.

3. The bot is a Fanogram asset
Per decisions log §6, every Telegram child bot we provision for you is a Fanogram-managed asset, not a creator-owned asset. This means:
- The bot's Telegram owner is the Fanogram Manager account, not your personal Telegram.
- You do not receive or have access to the bot token.
- You may not extract, transfer, or attempt to access the bot outside Fanogram.
- On cancellation, the bot enters a 6-month suspension period. Fanogram retains username recovery rights.
4. Content rules
- You retain ownership of your own content.
- You grant Fanogram a non-exclusive licence to host, transmit, and display your content as necessary to deliver the service (including watermarking, moderation, and chat delivery).
- You may not upload content that infringes third-party rights, violates law (including CSAM, non-consensual intimate imagery, terrorism content), or violates our acceptable-use policy.
- Adult-tier content is permitted on opt-in adult-flagged accounts only. See our privacy policy for KYC requirements.
5. AI-generated likeness media (Muse AI Studio)

Fanogram's AI Studio ("Muse") lets a creator train an AI model of their own likeness from their own vault photos and generate new media of that likeness, at their own direction. The following terms apply in addition to the content rules above:
- Eligibility (18+). AI likeness training and generation is available only to verified creators who are at least 18 years old. Generating a likeness of any person under 18, or of any real person who is not the consenting creator, is strictly prohibited.
- Likeness consent. Before any model is trained, the creator must sign an explicit consent attestation confirming they are the person depicted (or hold all necessary rights to the photos used) and that they consent to Fanogram training and generating media of their likeness on their behalf.
- Adult (NSFW) likeness media. Where enabled, generating adult content of a creator's likeness requires a separate, additional adult-content consent attestation and the creator's account being on the verified adult tier. The general (SFW) likeness consent does not imply adult consent, and neither implies the other.
- Revocability. Likeness consent — SFW or adult — is revocable at any time. On revocation, Fanogram stops generating new media with the creator's model and deactivates it.
- Prohibited content. AI likeness media may not be used to produce CSAM, non-consensual intimate imagery, content depicting another identifiable real person without their release, or any content that violates law or our acceptable-use policy. Prompts are screened, and generation that would violate these rules is blocked.
- Takedown. Fanogram operates a takedown process for AI-generated likeness media. Requests, including from a depicted person, can be sent to legal@fanogram.co and are actioned in line with our published takedown timelines.
6. Pro tier and Telegram Premium
The Pro Creator tier (decisions log §26.1) includes a Fanogram-funded Telegram Premium subscription on your personal TG account, controlled via the Telegram Business API through our Manager Bot. By upgrading to Pro you authorise Fanogram to gift Premium to your account monthly, drive your account via the Business API, and surface Premium-tier features (auto-translate, read receipts, voice-to-text, Premium reactions) on your behalf. Cancellation removes Premium at the end of the current billing period.
7. Payments
- Fan-to-creator payments are routed through high-risk processors (Paybl, CentroBill) or Telegram Stars. Fanogram is not the merchant of record on the card rails; we provide the orchestration layer.
- Creator-to-Fanogram payments (subscription fees, AI rev share, affiliate admin fees) are processed via Stripe. Fanogram is the merchant of record.
- Stripe is never used for fan-to-creator transactions regardless of how those transactions appear (decisions log §11).
- Payouts to creators settle monthly via Wise or TON per the creator's configured preference, subject to KYC stage 1 being complete.
8. Refunds and chargebacks
Refund policy follows the per-processor agreement plus our in-bot self-service refund flow (decisions log §17, agent-ops manual). Chargebacks are passed through to creators net of processor fees. Repeated chargeback ratios above the processor's threshold may result in account suspension.
9. Acceptable use
You must not:
- Impersonate any person or entity.
- Use Fanogram to send unsolicited bulk messages to people who have not opted in.
- Attempt to access another user's account, data, or encrypted credentials.
- Reverse-engineer the platform or attempt to extract proprietary data.
- Bypass our content moderation, watermarking, or anti-bypass rules.
10. Suspension and termination
We may suspend or terminate your account for serious or repeated breach of these terms, for fraud or abuse, or as required by law. We will give reasonable notice where practicable. You may close your account at any time from Settings → Profile.
11. Disclaimers and liability

12. Governing law

13. Changes
We may update these terms. Material changes will be announced via the dashboard and / or email at least 14 days before they take effect. Continued use after a change indicates acceptance.
